By accessing or using the tester.army platform and related services (the "Service") operated by TesterArmy ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the authority to enter into these Terms on behalf of yourself or your organization.

TesterArmy is an AI-powered QA testing platform. You provide website URLs, optional credentials, and test instructions. Our AI agent executes automated tests, captures screenshots, and delivers results through a chat interface. The Service also includes team collaboration, GitHub repository integration, scheduled test runs, API access, and webhook delivery.

To use the Service, you must create an account using Google OAuth, GitHub OAuth, or email magic link. You agree to:

Our property: The Service, including its software, design, AI models, branding, and documentation, is owned by TesterArmy and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Your property: You retain ownership of all data you provide to the Service, including project configurations, test instructions, and stored credentials. Test results and AI-generated outputs are provided to you as part of the Service — you may use them freely for your internal purposes.

Feedback: Any suggestions, ideas, or feedback you provide about the Service may be used by us without obligation or compensation.

The Service provides API access via API keys. You agree to:

In no event shall TesterArmy be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the above, we do not warrant that:

19. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Each party bears its own costs unless the arbitrator rules otherwise.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property or data security.

20. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by email or in-product notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

21. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TesterArmy regarding the Service, superseding any prior agreements.
